1. Services Provided
Clarks Landscaping Services (“we,” “our,” “us”) offers tree trimming, tree removal, brush clearing, snow shoveling, and related outdoor services. All work performed is based on the written or verbal agreement made between us and the customer.
2. Estimates & Pricing
Estimates are based on the information available at the time of inspection.
Prices may change if conditions differ from what was originally discussed (e.g., hidden hazards, additional labor, weather conditions).
Any price changes will be communicated and must be approved by the customer before work continues.
3. Scheduling & Weather
Work schedules may shift due to weather, road conditions, or safety concerns.
We will make reasonable efforts to notify customers of delays or rescheduling.
For snow-related services, response times may vary depending on storm severity and workload.
4. Customer Responsibilities
Customers agree to:
Provide clear access to the work area unless otherwise discussed.
Move vehicles, personal items, and valuables out of harm’s way.
Inform us of any underground utilities, irrigation, septic lines, or hazards on the property.
We are not responsible for unmarked or undisclosed underground or hidden obstacles.
5. Safety
We reserve the right to stop work if conditions are unsafe due to weather, animals, unstable trees, hazardous structures, or other risks. Safety is our top priority.
6. Property Damage
We take care to avoid damage to property. However:
We are not responsible for damage caused by pre-existing conditions, rotten wood, unstable trees, or customer-requested high-risk work.
Light scuffing or minor marks from equipment may occur in work areas.
Customers must notify us within 48 hours of any concerns.
7. Snow Removal Limitations
Snow shoveling and clearing reduces snow buildup but does not guarantee ice-free surfaces.
Customers are responsible for applying salt, sand, or de-icer unless otherwise agreed in writing.
We are not liable for slip-and-fall incidents on customer property.
8. Payment Terms
Payment is due upon completion unless other arrangements are made.
Late payments may incur fees.
Deposits may be required for large jobs.
9. Cancellations
Customers may cancel prior to the scheduled time without charge.
Cancellations after travel or equipment deployment may incur a service fee.
10. Liability
To the fullest extent allowed by law, Clarks Landscaping Services is not liable for:
Injuries resulting from unsafe property conditions not disclosed by the customer.
Natural events such as falling limbs, storm damage, or weather-related hazards before, during, or after service.
Damage to lawns, driveways, or walkways caused by necessary equipment use, especially during snow conditions.
11. Photos & Documentation
We may take before-and-after photos of work sites for records, safety reasons, and portfolio use. Customers may request that photos of their property not be used publicly.
12. Acceptance of Terms
By hiring Clarks Landscaping Services, the customer acknowledges and agrees to these Terms of Service.
